Customer has entered into a contract with Cooper Solutions, LLC for work to be done by Cooper on Customer's premises. Customer acknowledges that Customer is solely responsible to properly locate and mark all underground utility locations and Customer hereby fully releases and discharges Cooper from any and all responsibility and liability for any damages occurring to Customer or to any other party as a result of the failure of Customer to locate and properly mark these locations. Customer hereby indemnifies Cooper from any and all liability, including for costs and attorneys' fees, with respect to any and all claims for damages from any party as a result of Customer's failure to properly locate and mark underground utilities.
